Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PediNex ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

PediNex is developed by Gwimed, a healthcare software company building tools for clinicians. These Terms constitute a legally binding agreement between you and Gwimed ("we," "our," or "us").

2. Medical Disclaimer and Limitations

IMPORTANT — PLEASE READ CAREFULLY:

(a) Clinical Decision Support Tool Only. PediNex is a clinical decision support tool designed to assist qualified healthcare professionals in calculating pediatric medication doses. It is NOT a substitute for professional medical judgment, training, or expertise.

(b) User Verification Required. All dosing calculations provided by the App must be independently verified by the prescribing healthcare professional before administration. You are solely responsible for verifying the accuracy and appropriateness of all doses.

(c) No Warranties. While we strive for accuracy, we make NO WARRANTIES, EXPRESS OR IMPLIED, regarding the accuracy, completeness, reliability, or suitability of the information provided by the App.

(d) Professional Use Only. This App is intended for use by licensed healthcare professionals only. It is not intended for use by patients or the general public.

(e) Not Regulated. This App is not a regulated medical device and has not been evaluated or approved by regulatory agencies such as the FDA (United States), EMA (European Union), or equivalent agencies.

3. Eligibility

To use this App, you must:

Be a licensed healthcare professional (physician, nurse practitioner, physician assistant, pharmacist, or equivalent) authorized to prescribe or dispense medications in your jurisdiction
Be at least 18 years of age
Have the legal authority and competence to enter into this agreement
Use the App in accordance with applicable laws and regulations in your jurisdiction

By using this App, you represent and warrant that you meet these eligibility requirements.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal device(s)
Use the App for your professional clinical practice
Access the drug database and dosing calculations provided by the App

Restrictions

You may NOT:

Reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works of the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for any illegal or unauthorized purpose
Distribute, sublicense, rent, lease, or lend the App to third parties
Extract or scrape the drug database for commercial purposes
Use automated tools (bots, scrapers) to access the App

5. Subscriptions and Payment

5.1 Free and Premium Features

PediNex offers both free and premium subscription tiers. Premium subscriptions provide access to additional medications, formulations, and features.

5.2 Billing

Subscriptions are billed through the Google Play Store or Apple App Store. All billing inquiries and disputes must be directed to the respective app store, not to Gwimed.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Cancellation: You can cancel your subscription at any time through your app store account settings
No Refunds: Payments are non-refundable except as required by law

5.3 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect your current subscription period but will apply upon renewal.

6. User Responsibilities

As a user of this App, you agree to:

6.1 Clinical Judgment

Always use your professional clinical judgment
Verify all calculations before prescribing or administering medications
Consider patient-specific factors (allergies, comorbidities, drug interactions, etc.)
Consult additional references and specialists when appropriate

6.2 Data Accuracy

Enter patient weight and age accurately
Select the correct medication and formulation
Double-check all input values before viewing results

6.3 Compliance

Comply with all applicable laws, regulations, and professional standards
Follow your institution's policies and protocols
Maintain patient confidentiality (do not enter identifiable patient information)
Use the App only within your scope of practice and licensure

7. Intellectual Property

The App, including its drug database, algorithms, user interface, and all associated intellectual property, is owned by Gwimed and protected by copyright, trademark, and other intellectual property laws.

"PediNex," the PediNex logo, and other trademarks used in the App are the property of Gwimed. You may not use these marks without our prior written permission.

8. Data Sources and Updates

Our drug database is compiled from published medical references, including but not limited to:

British National Formulary for Children (BNFC)
Harriet Lane Handbook
Indonesian Pediatric Association (IDAI) Guidelines
Other peer-reviewed clinical guidelines

We make reasonable efforts to keep the database current, but we cannot guarantee that all information is up-to-date at all times. Always consult the most recent official guidelines and product information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) GWIMED SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES.

(b) WE ARE NOT LIABLE FOR MEDICAL ERRORS, ADVERSE PATIENT OUTCOMES, OR CLINICAL DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE APP.

(d) OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Gwimed, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any applicable laws or regulations
Medical malpractice or negligence in your clinical practice
Patient harm resulting from your clinical decisions

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Non-payment of subscription fees
Any reason at our sole discretion

You may terminate your use of the App at any time by uninstalling it from your device(s).

12. Privacy

Your use of the App is also governed by our Privacy Policy. Please review the Privacy Policy to understand our data practices.

Important

Do not enter personally identifiable patient information (names, medical record numbers, etc.) into the App. Only enter weight, age, and medication information necessary for dose calculations.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, providing in-app notifications. Continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Jakarta, Indonesia. However, we may seek injunctive relief in any court of competent jurisdiction.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gwimed regarding your use of the App, and supersede all prior agreements and understandings.
